The basis for approval for the following exceptions is because DWP has had some significant performance and service delivery issues with its Medical Services Assessment (MSA) contract and the supplier Atos. In March 2014, DWP reached a negotiated settlement with Atos to allow both parties to mutually terminate the current MSA contract with effect from 25 February 2015. During Market Engagement sessions, it became clear that the planned transition period (late October 2014 to Feb 2015) was insufficient time for HDAS bidders to carry out reasonable property Due Diligence activities and legal work to achieve the assignment and transfer of leases from Atos. In addition, DWP has yet to reach a settlement with Atos on liability and cost of dilapidations for the existing Atos sites. These two elements represented significant risk of market failure for the HSDAS procurement. To reduce the risk of market failure DWP Directors (within the Health Service, Commercial and Operations Directorates) took the strategic decision that DWP should take on the leases and causal hire responsibility for the Atos sites. This would allow bidders to focus on the strategic aim of the HDAS procurement and successful seamless transition from Atos. A lease assignment is required to support the successful delivery of the current Health and Disability Assessment Service (HDAS) for the Department.
